These terms are an agreement between you and {{DEVELOPER_LEGAL_NAME}}, {{POSTAL_ADDRESS}} ("we", "us") for the CapTheFlag apps for iOS and Android ("the app"). By using the app you accept these terms. If you do not accept them, do not use the app. Our Privacy Policy explains how we handle personal data.
1. Who can use the app
You must be at least 13 years old, or older if your country requires a higher age to use online services without parental consent. If you are under 18 (or the age of majority where you live), a parent or guardian must agree to these terms for you.
2. License
We give you a personal, non-exclusive, non-transferable, revocable license to download and use the app on devices you own or control, for your own non-commercial entertainment, in line with these terms and the rules of the store you got it from. We and our licensors keep all other rights in the app, its design, code, text and graphics.
3. Acceptable use
You must not:
- cheat, including using bots, scripts, modified apps, emulators or tools to answer questions or submit scores;
- send scores or other data to our servers other than through normal play in the official app, or tamper with requests;
- exploit bugs to gain an advantage instead of reporting them to us;
- create multiple accounts to manipulate the leaderboard or rewards;
- reverse-engineer, decompile or modify the app, except where the law allows it despite this restriction;
- disrupt, overload or try to gain unauthorized access to the app, our servers or other users' accounts;
- use the app in breach of any law.
4. Accounts and guest play
You can play as a guest or sign in with Apple or Google. Guest progress is stored on our server and linked to your device's app installation. Guest accounts that are inactive for 90 days are deleted automatically, and a guest account may be lost if you uninstall the app or clear its data. Sign in to keep your progress and appear on the leaderboard.
You are responsible for activity on your account. You can delete your account at any time in the app (Settings > Account > Delete account) or as described on Delete your account.
5. Leaderboard and fair play
Signed-in players appear on a global leaderboard that shows their username, best score, games played, accuracy, rank and Top 20 status. Usernames are assigned automatically and cannot be changed. Scores are checked by our server.
We may remove scores, reset statistics, remove a player from the leaderboard, withdraw rewards, or suspend or delete an account if we reasonably believe the player has broken section 3. Where practical, we will tell you why and you can contest the decision by emailing {{CONTACT_EMAIL}}.
6. Top 20 Rewards
Signed-in players ranked in the top 20 of the global leaderboard receive ad-free Premium free of charge while they stay in the top 20. It is a free skill contest: no purchase or payment is needed to take part or to win. The Top 20 Rewards official rules apply and form part of these terms. Apple Inc. and Google LLC are not sponsors of and are not involved in this promotion in any manner.
7. Purchases
- Remove Ads is a one-time, non-consumable in-app purchase sold through the Apple App Store or Google Play at the price shown in the store. It removes all ads from the app for the account and store account used to buy it. It does not unlock other content.
- Payment, billing, taxes and refunds are handled by Apple or Google under their terms. We cannot issue refunds ourselves. Request a refund from Apple at reportaproblem.apple.com or from Google Play in your order history.
- To get your purchase back on a new device or account, tap "Restore purchases" in the app while signed in to the same Apple ID or Google account.
- A Top 20 reward is a free promotional benefit, not a purchase. It ends when the reward period ends, and it does not turn into Remove Ads.
- If we stop offering the app, we will try to give reasonable notice. This does not affect your statutory rights.
8. Ads
Free users see ads provided by Google AdMob, such as banners on menu screens and occasional full-screen ads between rounds. Ads never appear during an active quiz. Your ad privacy choices are explained in the Privacy Policy. We are not responsible for the content of third-party ads or for products they promote.
9. Third-party content and geography
- Flag images are from Flagpedia.net and are in the public domain.
- Landmark photos come from Wikimedia Commons and are used under their Creative Commons licenses. Each photo's author and license are shown in the game and in Settings > Credits. Resized or cropped versions remain under the same license.
- Names, flags and capitals follow common international usage and do not imply any position on the legal status of any territory.
- We try to keep the quiz data accurate but cannot guarantee it is complete or current. Tell us if you find an error.
10. Disclaimers
The app is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties, express or implied, including fitness for a particular purpose, accuracy, or that the app will be uninterrupted or error-free. The app is a game and is not a reference work. We may change, suspend or stop features, game modes or the leaderboard at any time.
11. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential losses, or for loss of data, scores, rankings or rewards. Our total liability for any claim relating to the app is limited to the greater of the amount you paid us for the app in the 12 months before the claim and USD 10 (or the equivalent in your currency).
Nothing in these terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, fraud, or your statutory consumer rights. If you are a consumer in the EU or UK, you keep the protections of the mandatory laws of your country of residence.
12. Apple and Google
These terms are between you and us only, not Apple or Google. We, not Apple or Google, are responsible for the app and its content, maintenance, support, and any claims about it. If you downloaded the app from the Apple App Store, Apple's Licensed Application End User License Agreement also applies; if it conflicts with these terms, Apple's terms prevail for your use of the iOS app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app; Apple has no other warranty obligation to the extent the law allows. You confirm that you are not in a country subject to a US Government embargo or on a US Government list of prohibited or restricted parties. Google Play's terms apply to apps downloaded from Google Play.
13. Ending these terms
You can stop using the app and delete your account at any time. We may suspend or end your access if you seriously or repeatedly break these terms. Sections 9 to 15 survive termination.
14. Changes
We may update these terms. We will change the effective date above and, for material changes, tell you in the app before they take effect. If you keep using the app after that, the new terms apply.
15. Governing law and disputes
These terms are governed by {{GOVERNING_LAW}}. The courts of {{JURISDICTION}} have jurisdiction, but if you are a consumer you may also bring a claim in the courts of your country of residence, and you keep the protection of its mandatory laws. Before starting a claim, please contact us so we can try to resolve the issue.
